Overview of the Position

Social Solutions is seeking a full-time Construction Contracts Manager (the Manager) to support the contracting process for USAID-funded small-scale infrastructure/construction projects, primarily in the agribusiness sector, as part of the USAID Strengthening Competitiveness, Agriculture, Livelihoods, and Environment (SCALE) program in the Solomon Islands. The Manager will be part of the USAID Pacific American Fund (which Social Solutions operates in the Pacific region) which will be funding 10-20... small-scale infrastructure/construction projects in Malaita Province as part of SCALE.

The Manager will: work with key Pacific American Fund staff including the Construction Contracting Senior Advisor, the Construction Contracts Assistant, the Chief of Party, and others; coordinate and collaborate with a separate USAID implementing partner providing architectural and engineering services (A&E) that will complete analyses, feasibility studies, design, and construction oversight of the small-scale infrastructure projects; and help identify, oversee, and engage closely with a firm serving as Owner’s Representative (OR) that will represent Social Solutions in overseeing the execution of all contractual requirements, compliance, and risk management for the small-scale construction projects.

The Manager will be responsible for ensuring high levels of integrity in the entire construction subcontracting process to ensure that all work is carried out in full compliance with the technical specifications described in the contracts, with the prime contract Social Solutions holds with USAID, and with ADS 303 USAID Implementation of Construction Activities and USAID’s construction risk management policy.

Note, USAID defines small-scale infrastructure/construction projects as projects that are up to USD 500,000 in value. Examples of small-scale agribusiness infrastructure to be supported under this SCALE activity include farm-to-market roads, processing centers, warehouses, water and energy supply, and wharves.

Location

This position in based in the Solomon Islands, with work locations in both Honiara and Malaita Province. Solomon Islands citizenship/residency or the ability to obtain a work permit/visa is required for the position.

Period of Performance

The period of performance of this position is expected to be from approximately July 2021 to September 2022. A brief extension in the performance period may be possible, subject to USAID’s program timelines.

Reporting

The Manager will report to the Chief of Party of the Pacific American Fund.

Essential Duties and Responsibilities
• Support the project team with the construction procurement planning;
• Provide concurrence on proposed projects approved by USAID, including financial and design approvals;
• Manage the subcontracting procurement process including supporting: preparation of procurement packages (including Requests for Proposals) and issuance of solicitations; pre-bid (pre-proposal) meetings; supporting technical evaluation of proposals; discussion and negotiation with shortlisted offerors; and award of approximately 10-20 contracts;
• Leading coordination, engagement, and oversight of the Owner’s Representative’s responsibilities to manage the construction contracts (which will include but not be limited to: issuing notices to proceed; evaluating compliance with contract terms and completion of deliverables; receiving reports and forms; reviewing requests for change orders or modifications; holding bonds and warranties; issuing payments; and handing over completed projects to owners);
• Support development of subcontract terms and conditions, inclusive of FIDIC/AIA, applicable FAR, and AIDAR clauses;
• Support preparation of Scopes of Work and Bill of Quantities, and support efforts to establish responsibilities and procedures for the management and administration of the subcontracts;
• Ensure land tenure, gender and social inclusion, environmental and climate risk management, and cost and value engineering considerations are properly incorporated into and addressed in construction activities;
• Review subcontractors’ insurance policies and bid/performance and advance payment sureties/bonds for compliance with the prime contract and subcontract;
• Ensure that the OR administers subcontracts in accordance with agreed-upon procedures, including reviewing and making recommendations on any applications by subcontractors for contract variations including claims for extension of time or additional payment and other contractual disputes arising; and
• Maintain records of all contractual issues concerning the letting, progress and management of the subcontracts, and verifying compliance.

Requirements
• Bachelor’s degree in civil engineering, business, law, economics, or related field;
• At least 5-7 years of experience in small-scale construction contract administration including FIDIC and/or AIA contract administration;
• Familiarity with USAID standard construction/infrastructure bidding documents, acquisition (contracting/subcontracting) guidelines, and construction risk management policy would be an added strength;
• Knowledge and skills in subcontractor’s claims management, resolution of disputes, and arbitration proceedings in any project involving FIDIC/AIA general conditions;
• Strong interpersonal skills, ability to interact effectively with partners, donors, and other relevant stakeholders and personnel associated with this program;
• Professional experience working in the Solomon Islands or other Pacific Island Countries;
• High proficiency in both written and spoken English; and
• Overall experience working on USAID projects would be an added strength.
